Daily Report for Thu, Mar 06, 2008

Wealth creation versus destruction is the issue today. Others see it only as the sky-rocketing commodity prices and plunging US Dollar.
Thanks to a huge rally in energy and precious metal-driven stocks in the morning, the DJIA (+41.19 +0.31 pct to 12255), S&P 500 (+6.95 +0.47 pct to 1333.7), and Nasdaq Composite (+12.53 +0.47 pct to 2272.8) closed higher on Wednesday.
The ADP employment report had a -23,000 decline in private sector jobs, which is the first ever jobs decline reported by ADP. Revised 4Q productivity and costs increased more than originally reported. Non-farm business productivity lifted +1.9 pct and unit labor costs jumped +2.6 pct. The non-manufacturing ISM reading jumped to 49.3 last month, which was higher than consensus, versus 44.6 in January.
Following the weekly Department of Energy inventory report showed a surprising decrease in stockpiles, Crude Oil skyrocketed +$5.00/bbl to $104.52.
The $USD dropped to a new low of 73.45 (-0.30 pct) and the Euro lifted to 1.5263 in response to the move in the oil price. Early this morning, the March Euro is at 1.5319.
$GOLD closed up +22.20 to 988.50, reversing the previous day’s decline. Spot gold, palladium, platinum, and silver this morning is 986.74, 537, 2228, and 20.80 (high earlier at 21.21).
Comments & Outlook
These commodity price increases are not due to shortages, or even in fact to the declining $USD. It has mostly to do with the excessive printing of money by all nations over the past many years that when combined with the collapse of Humungous Bank & Broker (HB&B), leaves nowhere else to go.
Yesterday’s blog about India’s largest private bank, ICICI Bank (IBN), taking a large investment loss from a marked-to-market accounting system rather than simply a financial accounts provision for future losses based on the bankers’ traditional cost-based accounting system, really got me thinking about the growing disconnect between the Wealth Creators (the business owners, entrepreneurs) vs legal, accounting, banking and government Wealth Predators (the financial engineers and the politicians).
The latter group – we owners of capital call them variously the suits, the overhead, the floaters – make their income the old-fashioned way via control, manipulation, deception, obfuscation, and so forth. Sucking and blowing at the same time.
Apparent to everybody at the PDAC Convention is the fact that it is the Miners – the explorers and developers – who are true wealth creators in the world, and not the syndicators and the lawyers who created those schemes.
The capital markets are now in trouble because these interventionists (differentiated from agents or middle men) have gotten too powerful and that power has corrupted the system.
The very act of securitizing pools of assets of dubious economic value and then seemingly protecting themselves with a form of self-insurance called credit derivatives, neither of which the average person could possibly understand because there was an intent not to have us understand their charade, has brought the world to the brink. Aided and abetted by lawyers.
The only reason these problems came to light was because there was discord amongst the interventionists themselves, some of whom last June simply said, “enough is enough, I am not paying a dollar for twenty wooden nickels even if the seller is my colleague banker; I will instead buy commodities that have utility, and hence a measure of economic value, to my clients.”
There was a break-out session here on finance using a scheme that has been mastered by corporate finance lawyers who now want to supplant the investment bankers to become the dealmakers. As I watched these lawyers on the stage posturing and preening like gunslingers, I thought to myself, these people just don’t get it. They are all packaging and no content. In effect they are telling the owners of capital that the only way to access the wealth creators is via financially engineered products that only they can create. And I thought of all the nonsense these people and they bed-mates in politics have created like National Instrument 43-101, flow-through share tax shelters, USA Patriot Act, and so forth. For what purpose; to help create wealth or to enrich themselves by strengthening their control over the wealth creators and the owners of capital who are prepared to take the risk to help those who create wealth?
Yes, this may not make many friends for me, but what really pissed me was the swagger of these young lawyer studs who are in effect wealth predators. Without recognizing a drill bit if it was sitting on the ends of their noses, they come into the mining convention and act like God's gift. In the Financial Post free hand-outs at the PDAC, they also pushed their underwriting record as if anybody here cares. The only underwriter of record not associated with one of these self-promoting legal firms is Canaccord. Kuddos to Peter Brown.
I'm exercised about this because at the Rob McEwen party the other evening, I found myself in a nest of some of Toronto's top securities lawyers giving them a piece of my mind of the legal system that permitted an engineered fraud of Stelco. As long as they network and control matters, they earn fees far above what they should, which is fine, but when they hold their noses while their clients screw the shareholders and bondholders like what happened at Stelco, I have to speak up. And when I see their industry's marketing push here at PDAC, I want to scream.
Tomorrow, I'll calm down. Then when I gather my thoughts I intend to get right back into it because somebody has to stand up to the nonsense these lawyers are bringing to capital markets.
I'll even go so far to say that if bankers rejected the schemes offered up by the bright lights of the legal profession, HB&B wouldn't be in so much trouble today.
